I haven't found any evidence of people being banned for xPick, so you're 'safe' for the time being.

i also have heard of people using and not getting banned, can't remember if it was some spammer or someone talking to friend about it... is it new?? if it is its probably undectectable until someone at blizzard finds a way to detect it, but with the growing popularity of WOW they probably have less staff or Diablo.

Is that why all other packet sending software gets people perm banned? You can use those to make someone hit ACCEPT on a trade window for christs sake.
