OT: legal issues?
#1
Hey all, sorry for the horribly off-topic post, but this is the only site i have a membership with to post Smile

Ive been wondering, is it legal for a hospital to keep a minor for medical treatment completely against their will? I was wondering, cus I hadda go a few weeks ago to get my stomach pumped cus i was "overdosing" (BS, ive taken 10 times more than that and had some friggin fun!, but thats besides the point). For anyone who has had that done, you know what an excrutiatingly painfull thing that is.. i wont even get in to the catheter thing.....
Well, i was NOT brough there by police, nor did a guardian give them consent to keep me, and most importantly I definitely did not want to be there. SO.... im seriously praying that i have a potential legal suit on my hands, cus that hospital has put me thru hell, many times, but there was nothing i could do then as i was there in police custody. At the very least for pain and suffering(i hadda throw away a few pairs of boxers over the next week...)at most for keeping me in the FRIGGIN ICU OVERNIGHT when my heartrate was normal, and i had obviously come down a long time ago. They also denied me the chance to get an outside opinion of my condition. There were also some things said by nurses and whatnot, implying that i didnt REALLY need to be there, but they were just teaching me a painfull lesson. So that amounts to about 20,000$ just from the icu, when my mom didnt sign my rights over to them, and i sure as hell didnt give them consent to put me there, and they denied me a second outside opinion(i know other state-agencies such as mental institutions and whatnot are required to let you have one). Also, they refused to tell me what was going in my IV, for all they knew, i couldve been allergic to potassium chloride and died, cus i didnt give them any of my information, they didnt even know my name.

Well, do you think im some way entitled to some cash here due to malpractice and/or violating patients' rights? 20,000 bucks to pay off that icu debt would be acceptible... hell id settle to have them let me shove a tube up docs nose

Hmm, this turned out to basically be a ***** post :o , but i needed to vent some crap...

Dex, sorry, but doctors have more power over the lives of people than the Prime Ministers, Presidents, etc. They can order you stay in the hospital if it will benefit your health, whether you like it or not. About them not telling you what was in the IV, and not giving you a second opinion, that violates patient's rights. You might have something, but you're going to need a good lawyer.
