You can, because they're using their own server, plus a mod they made, no profit is being made.

it doesnt matter about the profit the emulation of a battle.net server is illegal only way to run w/o being illegal is with tcp/ip games or written consent of blizzard entertainment
did you not hear about the recent private server that was sued by blizzard for the same thing and i play on there server lol but whoever it was was dumb to post it
