Anyway, I'm going to close this. I'm sure he got the message.
For the future - Yes, legal action can be taken if this occurs. If the ISP doesn't do anything about it - we can always prevent anyone using that ISP from accessing the site. We have almost banned AOL before. I'm sure all the people leaving/arguing with AOL would convince them to take the time to look into the initial problem.
